Dollarama Class Action Lawsuit Canada: Claim Deadline, Eligibility

The Dollarama class action lawsuit final approval hearing was held on 02 December 2024, and the Court has approved the settlement. The eligible class members who wish to receive the compensation should file the claim before 14 Feb 2025.

Dollarama Class Action Lawsuit Canada

The Quebec consumer has filed a case against Dollarama Inc.m Dollarama S.E.C., and Dollarama GP Inc. on 29 May 2023 about the prices displayed on the Dollarama products and charged subject to Ecofees (environmental handling fees) in Canada.  The plaintiffs claim the defendant charged the higher prices that are allowed for these products as per the law.

The plaintiff claims the defendant misled the consumers as they properly did not display the prices of such products. The Defendants denied the allegations or any wrongdoing and proposed to settle the lawsuit with a settlement fund of $2.6 million ($2,643,718.75).

The court has given the final approval to the Dollarama class action settlement, and the class members who wish to receive the compensation should submit the claim form before the deadline, 14 Feb 2025.  The deadline to exclude from the Dollarama settlement has passed, that is, 22 November 2024.

Who can claim the Dollarama Class Action Lawsuit compensation?

According to the settlement agreement, Canadians who meet the following eligibility criteria are the class members of the Dollarama settlement and claim the compensation:

• You have purchased an Ecofees product from Dollarama in Quebec between class period, 11 Dec 2019 and 04 July 2023 or other places in Canada between 29 May 2021 and 04 July 2023.

The class members should make sure they have a valid email address and a bank account that can receive payments through E-transfer. When your claim is accepted or validated by the settlement administrator, only then you can receive the compensation.

Dollarama Class Action Lawsuit Payout

Under the Dollarama class action settlement, the administrator will first cover the following Court-approved expenses before disbursing the compensation to the valid claimants from the $2.6 million:

• Class Counsel will receive fees up to $800,000
• Class counsel expenses amount to $25,000 with applicable taxes on both fees and expenses;
• Settlement administrator fees and expenses administering the settlement

After the administrator deducts the above expenses from the gross settlement fund of $2.6 million, the remaining funds will be used to compensate the class members who filed the valid claim for the Dollarama compensation.

According to the settlement agreement, the approved claimants will receive an equal amount from the net settlement fund. As per the administrator estimate, each approved claimant can expect a minimum compensation of $3 and a maximum compensation of $10.

When can you expect the Dollarama Class Action Lawsuit Payout?

The Court has granted the final approval for the Dollarama Class action lawsuit, so the class members can expect compensation in their accounts after the deadline to file a claim is passed. If there is no appeal filed against the Dollarama class action settlement the distribution of payment will begin after a month of claim form a deadline as the administrator will take time to review the claim and decide the approved claim.

The appeal against the court decision will stop the administrator from distributing the compensations until the appeal is resolved or withdrawn. So, if there is no appeal, the approved claimants can expect their Dollarama settlement compensation in March or April 2025.

The settlement administrator will transfer the Dollarama compensation amount through Interac E-transfer. The claimants should understand the administrator will compensate for all the products purchased during the class period subject to Ecofees through one E-transfer. If the settlement payout is less than $3 then the administrator will not make any E-transfers and the distribution fund will go to charities.

The administrator will calculate the payout amount based on the number of claims, purchased products, etc. So, the claimants would know the settlement amount for each person after the deadline has passed.
