The US District Court of Tampa Division granted the final approval for the Walmart Weighted Groceries settlement on 28 June 2024. The settlement resolves the lawsuit filed against Walmart over deceptive business practices.
The class members with valid claims are yet to receive compensation for paying more for certain products sold by weight. The payout is long due now, the class members waiting for the payment can check the payout details here.
Walmart Settlement Payout Date
The lawsuit was filed against Walmart stores in October 2022 claiming the company has used deceptive practices as they overcharged the sold-by-weight groceries and violated the FDUTPA (Florida Deceptive and Unfair Trade Practices Act). This led to customers paying more for certain goods sold by weight, such as meats, pork, fruits, seafood products, etc.
Walmart denied any wrongdoings, however, agreed to resolve the case with a settlement of $45 million. The federal court approved Walmart Weighted Groceries’ $45 million settlement almost five months ago. The class member who has filed the claim before the deadline, 5 June 2024 to receive the settlement benefit now awaits the settlement payout.
The settlement payout is processed by the Settlement administrator, after the approval, the class members expect the payment in two-three months, however, payment has not been made yet. The claimants should know the claims administrator will post an update on the website when they begin the payment process. According to reports, the class members can expect the payment by the end of 2024.
Walmart Settlement Payout Distribution
The $45 million settlement fund of Walmart Weighted groceries will first used to cover the below expenses before it gets distributed among the valid claimants:
- Settlement administration and Notice costs
- Attorney’s Fee and expenses
- Tax and taxes related to the settlement fund
- Other court-approved fees
After the above expense is deducted from the settlement amount, the remaining net settlement fund will be used to compensate the valid claimants. The approved claimant will receive compensation from the Net settlement fund based on the amount of bagged citrus and weighted goods they have purchased during the class period and the number of claimants.
The compensation among the valid claimants will be distributed based on the number of purchased items and proof of purchase.
Walmart Settlement Payout per person
The compensation per person will be decided based on the pro-rate hike and decrease and the payment distribution. However, based on your purchase or proof of purchase, and other factors, the claimants can expect the following payout:
- If you did not submit the purchase evidence or other documentation but attest to buying 50 Bagged Citrus/ Weighted goods in person at the Walmart stores during the class period, you may receive $10.
- If you have no proof of purchase but attest to buying 51 to 75 Bagged Citrus/ Weighted goods in person at the Walmart stores during the class period, you may receive $15.
- When you have no proof of purchase but attest to buying 76 to 100 Bagged Citrus/ Weighted goods in person at the Walmart stores during the class period, you may receive $20.
- When you have no proof of purchase but attest to buying more than 100 Bagged Citrus/ Weighted goods in person at the Walmart stores during the class period, you may receive $25.
- If you have submitted proof of purchase, such as a receipt or other documentation, you may receive 2% of the total cost of purchase of Bagged Citrus/ Weighted goods at Walmart store during the class period, as per the estimate, the valid claimants may receive up to $500.
Who will receive the Walmart Settlement Payout?
People who meet the following eligibility conditions for a class member and submit the claim will receive the Walmart settlement payout:
- You have bought the weighted goods or Bagged Citrus (organic oranges, tangerines, grapefruit, etc.) in person at a Walmart store, supercenter, or neighborhood market in Puerto Rico or the United States during the class period,19 October 2018 and 19 January 2024.
- The weighted goods in the settlement mean weight meat, pork, poultry, seafood products, and others labeled with a barcode and designated by Walmart in 93 products Department.
- You have not been excluded from the settlement through submitting the official excluded form before the deadline.
How will you receive the Walmart Settlement Payout?
The settlement class members with approved claims can receive compensation through the payment method they have selected in the claim form. The settlement administrator has kept the following payment method for the Walmart Weighted settlement:
- Venmo
- Zelle
- Physical Check
- Virtual Prepaid Card
The administrator has not restricted or limited the expiration dates on electric payments, still you should immediately uncashed the settlement.
Class members who have opted for the physical check may have to wait longer than the people with the electronic method as it depends on your mailing address. Claimants if they have any changes in their payment method like mobile number or mailing address should immediately inform the settlement administrator to ensure they receive the compensation timely.
